GIG Alarm – Privacy Policy and Data Usage

1. Introduction
Welcome to GIG Alarm. We take our users’ privacy very seriously and are committed to protecting your personal information. This Privacy Policy and Data Usage explains how we collect, use, store, and share your data when using our alarm application.
This policy complies with applicable data protection regulations, including:
Federal Law on the Protection of Personal Data Held by Private Parties (Mexico)
California Consumer Privacy Act (CCPA) and other U.S. state privacy laws
General Data Protection Regulation (GDPR) – European Union
Children’s Online Privacy Protection Act (COPPA) – United States
This policy is available in Spanish as the primary version. We recommend that users read it in a language they understand to provide valid consent.
By using the GIG Alarm app in Mexico, the United States, or Canada, the User gives express consent for their personal data to be collected, used, stored, and transferred according to this Privacy Policy. This includes processing by third-party providers located in countries other than the User’s country of residence.

2.3 Third-Party Data
When the User wishes to send a GIG (alarm) to another person, they must provide certain personal details of the recipient, such as name, phone number, and email address. The User’s device may suggest autofill options using its internal memory (frequent contacts or saved addresses).
By entering this data, the User declares they have the third party’s consent to share their information with GIG Alarm. This data will be used exclusively for sending GIGs and will not be shared for other purposes.
GIG Alarm may, at any time, contact the third party to confirm their consent or to allow them to exercise their rights over their personal data.
GIG Alarm reserves the right to reach out to the third party to confirm their authorization or to enable them to exercise their rights in accordance with the Federal Law on the Protection of Personal Data Held by Private Parties (Mexico).
2.4 Restrictions for Children Under 13
GIG Alarm is not designed for children under the age of 13. We do not knowingly collect data from minors without verifiable parental or guardian consent. If we discover that we have collected such data, we will delete it immediately.
Users aged 13–17 must have parental or guardian consent or supervision to use the app.

3. How We Use the Data
We use the information collected to:
Provide and improve app functionality
Send notifications and reminders configured by the user
Personalize the user experience
Enhance security and prevent fraud
Comply with legal and regulatory obligations
Send updates or changes to the app (users may opt out of promotional emails)
4. Data Sharing with Third Parties
We do not sell or rent user data. However, it may be shared in the following cases:
Service providers: Companies that assist with payment processing, cloud storage, and analytics
Legal compliance: When required by law or authorities
Protection of rights: To enforce our terms or protect user safety
Other apps from the same company: We may share data between GIG Alarm applications, only if the user has accepted this privacy policy. If GIG Alarm releases a new app, users will be clearly notified through the current app or by email. Consent may be withdrawn at sendmeagig@gmail.com.
Data transfer between apps developed by GIG Alarm does not constitute a sale under the CCPA, as no monetary or economic gain occurs. Users can still request that their data not be shared across apps.
5. International Data Transfers
GIG Alarm may transfer, store, and process user data on servers located outside the country from which the app is accessed, including the United States. These transfers occur through providers such as Twilio, Railway, Framer, Resend, RevenueCat, and Namecheap. GIG Alarm ensures all transfers comply with applicable law (GDPR, CCPA, PIPEDA, and Mexican data law).
Canadian user data may be transferred to U.S. providers for processing. By using the app, users give express and informed consent for this transfer under PIPEDA.
6. External Technology Providers
GIG Alarm uses external providers to offer core functions such as authentication, messaging, notifications, subscription management, and infrastructure deployment. These U.S.-based providers may access limited personal data strictly for service delivery, under confidentiality and usage agreements.
Some may also use tracking technologies such as cookies or pixels, for internal analytics only. Users may review specifics in a separate Cookie Policy or supplementary notice.
These technologies are used exclusively for technical, statistical, or internal analytics purposes. The User may review specific details in the Cookie Policy or supplementary notice on the use of such technologies.
7. Data Storage and Security
Personal data is stored on secure servers with appropriate security measures.
Encryption and access controls are in place to prevent unauthorized access.
We do not store payment data directly; payments are handled by secure third-party platforms (App Store, Google Play).
8. User Rights
Under GDPR, CCPA, PIPEDA, and related laws, users have the right to:
Access their data
Correct inaccurate information
Request deletion of their data, except for data required for app functionality, internal analytics, or legal compliance
Object to data use for specific purposes

If a User refuses or withdraws consent for essential data processing—such as contact registration for GIGs or authentication data—GIG Alarm may restrict access to certain features or terminate the account.
We may also suspend or cancel accounts if the User’s decisions, complaints, or requests prevent the lawful or technical operation of the service.
Requests will be processed within legal timeframes (generally 20 to 45 calendar days).
9. Data Retention
We retain data only as long as necessary for service provision and legal compliance. If the account is deleted, data will be erased within 90 days unless legal grounds require otherwise (e.g. tax, fraud, or security reasons).
10. Use of Cookies and Similar Technologies
We use cookies and related technologies to enhance user experience and analyze usage. Users may configure their devices to reject or delete stored cookies.
11. Legal Compliance and Regulatory Requirements
We comply with the following data protection laws:
GDPR (EU): Data collection, storage, and deletion
CCPA and other U.S. state laws: Consumer rights and data protection
PIPEDA (Canada): Privacy and data handling standards
COPPA (USA): Protection of children’s privacy (under 13)
Mexican Federal Law: Personal data use and ARCO rights
We will only share personal data with authorities when legally required.
12. Limitation of Liability
Force Majeure: GIG Alarm is not liable for any failure caused by circumstances beyond our control, including but not limited to: force majeure events, internet or telecom outages, third-party server failures, pandemics, government orders, or natural disasters.
GIG Alarm provides the app “as is” and “as available,” without guarantees of error-free or uninterrupted service.
We do not guarantee alarms will trigger in all cases and are not responsible for technical malfunctions, system settings, or lack of permissions.
If the app malfunctions, GIG Alarm is not responsible for direct, indirect, incidental, special, or consequential damages, including data loss, disruption of personal or professional activities, or inability to use the service.
Users are responsible for maintaining the technical environment required for app functionality.
GIG Alarm reserves the right to terminate accounts that, in its judgment, block the technical or legal provision of the service.

We may update this policy periodically. Significant changes will be notified through the app or via email.

14. Jurisdiction and Dispute Resolution
This policy and any dispute arising from GIG Alarm usage shall be governed by the laws of Mexico, the U.S., or Canada, depending on the user’s jurisdiction.
However, all claims or disputes shall be exclusively resolved in the courts of Mexico City, Mexico. Both parties expressly waive any other jurisdiction.
15. Country-Specific Rights and Compliance
15.1 Mexico
In accordance with the Federal Law on the Protection of Personal Data Held by Private Parties, Users have ARCO rights:
Access their data
Rectify inaccurate or outdated data
Cancel data that is no longer necessary
Object to its use for specific purposes

15.2 United States (including California)
Users have the right to:

Opt out of certain uses, such as marketing
California residents are protected by the CCPA, including the right to opt out of the sale of their data (not applicable at GIG Alarm).
15.3 Canada (PIPEDA)
Canadian users have the right to:

Access, correct, or delete their data
Withdraw consent at any time
File a complaint with the Office of the Privacy Commissioner of Canada
