GIG Alarm – Terms and Conditions of Use
1. Definitions
Application: The software provided by the Company, downloaded by the User on any electronic device.
Company: AGUISAFI S.A. DE C.V., owner of the GIG Alarm application.
Device: Any device capable of accessing the Service, such as a mobile phone or tablet.
Personal Data: Any information that may identify the User, such as name, email address, or unique identifier.
User: Any person who accesses or uses the Service.
Alarm: A notification scheduled by the User to remind themselves or others of tasks, appointments, or events.
GIG: The name used to describe an alarm sent to a third party.
Recurring: An alarm configured to repeat periodically at specific days and times.
Cancellation Code: A code that allows marking an alarm as completed.
2. Creating and Managing the User Account
2.1 Account Creation Process
The User must register their phone number or email address.
A verification code will be sent via SMS. Once validated, the User must complete their profile with: Full name, Phone number, Email address, Date of birth, State of residence, Gender, Country, City.
2.2 Important Conditions
The phone number functions as the unique account identifier.
To change it, the User must request the update via support email. The Company will respond within 10 days.
The email address can be updated in-app before changing the phone number.
If the User cannot verify their email, they will not be able to manage the phone number change.
If the User no longer has access to their registered email, they will not be able to complete the phone number change process.
2.3 Data Modification
From the app settings, the User can modify:
Full name
Date of birth
State
Gender
Email address
Phone number cannot be changed directly through the app.
3. Sending and Managing Alarms to Third Parties (GIGs)
The application allows Users to send alarms to others to remind them of important tasks or commitments. To ensure responsible usage, the following conditions apply:
3.1 Alarm Acceptance
The recipient must accept the alarm to activate it.
They may accept a single alarm or future alarms from the same sender.
Accepted alarms activate notifications and send confirmation to the sender.
3.2 Contacts
Users may add any type of contact to the app to send or receive alarms, including family, friends, clients, or others. There is no limit to the number or type of contacts.
Contacts can be deleted at any time in the app settings.
3.3 Limits and Conditions
Use of the app to send spam or harass others is prohibited.
The Company may suspend accounts for misuse without refund.
4. Alarm Verification and Confirmation
For received alarms, the confirmation code will be sent directly within the app.
The Company is not responsible if the code is not received due to device or network issues.
5. Alarm and Notification Behavior
An initial alarm is sent at the scheduled time.
If not addressed, reminders will be triggered as detailed below..
If postponed, notifications resume after the selected delay.
If canceled via the verification code, no further notifications are sent—unless it is a recurring alarm.
All alarms include sound, but they will only play if:
The device is not in “Do Not Disturb” mode
The User granted notification permissions
The User is responsible for maintaining these settings to ensure proper alarm function.
Each time an alarm or GIG is triggered, the User will receive 16 notifications in two phases: two consecutive notifications sent immediately, followed by fourteen additional notifications spaced one minute apart.
During this process, the User may postpone or enter the cancellation code.
If unanswered, notifications stop, but the event remains pending in the app and is shown upon next access.
6. Subscriptions, Payments, and Cancellations
6.1 General Conditions
The app includes a 7-day free trial.
After that, the User must subscribe (monthly or annual plan).
Payment is processed via App Store or Google Play.
Subscriptions renew automatically unless canceled beforehand.
6.2 Refunds and Billing
Refunds are only issued according to store policies.
Users must request refunds directly from Apple or Google.
In case of billing errors, Users can contact support by providing:
Name and email
Description of the issue
Proof of charge
Support will respond within 10 business days (this does not guarantee a refund).
6.3 Restrictions
Some features are only available with an active subscription.
If no subscription is purchased, access to the app will be restricted.
6.4 Cancellation
Users may cancel their subscription via the app store. They may also visit the official GIG Alarm website to find the support email.
The app remains active until the paid period ends.
7. Communications and Notifications
The User agrees to receive:
Updates and announcements of new apps or related products via in-app notifications
In-app notifications (reminders and features)
Emails related to updates or security
SMS messages for essential notifications only
vSurveys are only sent within the app.
If the User revokes essential permissions or interferes with the technical or legal operation of the app, GIG Alarm reserves the right to restrict functionalities or cancel their account.
7.1 Communication Control
In-app notifications cannot be disabled.
Users may opt out of promotional emails.
SMS is only used for essential or security matters.
8. User-Generated Content
The User is responsible for the content and use of the alarms they send.
It is prohibited to use the app to harass, threaten, or harm others.
The Company may suspend accounts for violations.
9. Use by Minors
The app is not designed for unsupervised use by minors.
Accounts for minors must be authorized by a legal guardian.
GIG Alarm is not intended for children under 13.
Users aged 13 to 17 require adult consent or supervision.
10. Intellectual Property
All rights to the app, content, logos, and code are owned by AGUISAFI HUB S.A. DE C.V.
Reproduction or modification without permission is prohibited.
11. Jurisdiction and Governing Law
These Terms are governed by the laws of the United Mexican States.
Any disputes shall be submitted to the courts of Mexico City.
The Company may update these Terms and Conditions at any time.
Changes will be notified via the app or email.
New terms take effect 30 days after publication, unless legal or security reasons require immediate application.
Continued use of the app after changes become effective constitutes acceptance.
The Company is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use or inability to use the app.
The Company is also not responsible for service failures due to force majeure or circumstances beyond its reasonable control, including but not limited to:
Internet or power outages
Technical failures
Natural disasters
Pandemics
Labor disputes
Government orders
12. Legal Provisions by Country
Mexico: These Terms comply with the Commercial Code and Federal Consumer Protection Law.
United States: GIG Alarm complies with the Telephone Consumer Protection Act (TCPA) and other federal and state laws. By accepting these Terms, the User consents to receive automated notifications and essential communications.
Canada: In accordance with the Canadian Anti-Spam Legislation (CASL), the User expressly consents to receive in-app notifications and electronic communications necessary for the operation of the application.
